Description: Earlier this year, the Department of Labor announced a new rule modifying the “white collar” exemption tests for executive, administrative, and professional employees under the Fair Labor Standards Act (FLSA).
The new salary test, which goes into effect this year on December 1, will increase the salary threshold for whether an employee is overtime exempt from $455 per week ($23,660 annually) to $913 per week ($47,476 annually).
Employers must plan how they will address scheduling, payroll, and overtime issues caused by the rule change. Paying employees bonuses can quickly become complicated under the FLSA and employers need to keep apprised of the FLSA changes and how it may affect their business model.
